This landmark decision follows extensive mediation proceedings, with the top court being informed of the amicable settlement on Friday, July 31. The resolution marks the end of a lengthy legal journey that has spanned nearly two decades for the political family.

Mediation Success at the Supreme Court

Senior Advocate Kapil Sibal, who represented Omar Abdullah before a bench comprising Justice PS Narasimha and Justice Alok Aradhe, announced that all disagreements between the couple had been successfully resolved. According to legal news platform Bar and Bench, the advocate made this significant submission during the hearing, highlighting the positive outcome of the mediation process.

Both of them have embraced freedom. It’s all settled. Lordships may grant a divorce. All other matters will be withdrawn.

The bench was informed that the divorce petition had been initially submitted on July 22. Upon receiving this information, Justice Narasimha indicated that the Court would issue appropriate orders. Sibal further clarified that both parties had consented to withdraw all pending cases they had filed against one another, demonstrating their commitment to moving forward independently.

Responding to these developments, the bench remarked, “That’s good. We will dispose it of on those terms.” This statement reflected the Court’s satisfaction with the mutual agreement reached between the couple after years of separation and legal proceedings.

Extended Legal Battle Through Multiple Courts

The National Conference leader approached the Supreme Court seeking intervention under Article 142 of the Constitution. This constitutional provision grants the highest court authority to pass any order deemed necessary for achieving complete justice in a case. Historically, the Supreme Court has utilized this provision to dissolve marriages that could no longer be salvaged through conventional means.

Omar’s legal battle began much earlier. His initial divorce request was turned down by a family court in August 2016. That court determined he had not successfully demonstrated that his marriage had irretrievably broken down. Undeterred by this setback, he appealed to the Delhi High Court, which also rejected his petition. He subsequently sought relief from the Supreme Court, beginning a new chapter in his quest for divorce.

In August 2024, the Supreme Court directed both parties toward mediation after they agreed to pursue an amicable resolution. The Court postponed the hearing to receive the mediator’s findings, allowing time for both parties to work through their differences and reach a mutual understanding.

Marriage and Separation Timeline

Omar and Payal exchanged vows in 1994, beginning a marriage that would span over three decades. Their relationship began to unravel in 2009, with a formal public declaration of their separation arriving in September 2011. This timeline demonstrates that the couple had been living apart for approximately 17 years before finally reaching a resolution through the Supreme Court’s mediation process.

Political Career and Achievements

Since 2024, Abdullah has held the position of chief minister for the union territory of Jammu and Kashmir, while simultaneously serving as the leader of the house in the J&K Legislative Assembly. Prior to this, he led the state of Jammu and Kashmir as chief minister from 2009 to 2014, establishing himself as a prominent political figure in the region.

He has been vice president of the Jammu & Kashmir National Conference since 2009. His parliamentary career includes serving as a Lok Sabha member from 1998 to 2009, representing the Srinagar constituency. Additionally, he held the role of Union Minister of State for External Affairs during his political journey.

The son of former Jammu and Kashmir State chief minister Farooq Abdullah, he entered politics in 1998 after becoming the youngest member elected to the Lok Sabha. He achieved this distinction in the following three elections as well. During Atal Bihari Vajpayee’s NDA government, he served as Union Minister of State for External Affairs from July 23, 2001, to December 23, 2002.
