Understanding the new restrictions

Under the updated framework, the US government can now deny visas to foreign nationals who are responsible for or complicit in cyber-enabled criminal activities. The policy operates under Section 212(a)(3)(C) of the US Immigration and Nationality Act, which permits visa restrictions when an individual’s entry could produce adverse foreign policy consequences. The scope covers cyberscams, online investment fraud, sextortion, and related offenses.

“The United States will go after those who prey on our citizens,” Rubio stated, emphasizing the administration’s commitment to using every available legal and diplomatic tool.

The initiative follows President Donald Trump’s Executive Order 14390 on combating cybercrime and predatory schemes. According to Rubio, online investment scams have emerged as a significant national security and financial threat. Scammers, often allegedly connected to Chinese transnational criminal organizations, defrauded US citizens of at least $10 billion in 2024 while contributing to money laundering, corruption, and human trafficking.

Immediate family members of individuals engaged in these criminal activities may also face visa restrictions. The policy targets those responsible for cybercrime, complicit in cyber-enabled crime, involved in cyberscam operations, and linked to sextortion schemes. Notably, the statement does not identify specific countries or individuals that will be targeted under this global framework.

This announcement arrives one week after the State Department introduced a separate visa restriction policy focused on far-left terrorist groups. That earlier policy, announced in support of National Security Presidential Memorandum-7, targets foreign nationals accused of supporting terrorism, participating in violent criminal activity, and facilitating cooperation among extremist networks. Together, these measures reflect the administration’s broader approach to protecting American interests both domestically and internationally.
