“We’re tired of the federal government not putting limits on who can come in under H-1Bs,” Abbott said.

He warned that Texas would be compelled to make “tough decisions” in the absence of adequate federal oversight over the programme.

A Broader Anti-Foreign-Influence Agenda

The H-1B ban is one component of a wider legislative push aimed at curtailing foreign influence across Texas public education. Abbott said he would also seek laws barring public schools from accepting gifts, funds, or property originating abroad, and from forming partnerships or financial agreements with foreign entities. He singled out arrangements tied to countries such as Qatar and China, contending that such ties could shape curriculum content.

“Foreign influence of any kind has no place in our classrooms,” Abbott said.

Why the Ban Matters for Texas Districts

The proposal lands in a state where foreign-trained educators fill a disproportionate share of teaching vacancies. A 2025 analysis published by the National Education Association found that Texas school districts employ more H-1B visa-holding educators than districts in any other state in the country. While universities and affiliated medical institutions absorb much of the H-1B employment in the education sector, certain K-12 districts rely on the programme to staff hard-to-fill posts, particularly in bilingual education. A prohibition would push those districts to seek alternative recruitment channels for specialised roles.

National Context: Heightened Scrutiny of the Programme

Abbott’s initiative arrives amid intensified examination of the H-1B system under President Donald Trump’s administration, which has levelled criticism at employers alleged to use foreign workers in place of American staff or to suppress labour costs. Applications for the visa are processed and adjudicated entirely at the federal level. Because H-1B holders are heavily concentrated among nationals of India and China, any substantial policy shift carries outsized consequences for Indian professionals working in the United States.

Demand Remains Undiminished

Despite the political turbulence surrounding the programme, employer demand shows no sign of easing. On July 17, 2026, the US Citizenship and Immigration Services announced that it had received enough petitions to exhaust the fiscal year 2027 H-1B cap. That cap comprises 65,000 regular visas plus an additional 20,000 slots reserved for foreign nationals holding advanced degrees from US institutions.

The Legislative Hurdle

Abbott cannot impose the ban by executive action alone. The Texas Legislature must first draft and pass legislation codifying the restrictions before the governor signs it into law. Should the measure clear both chambers, it would constitute a major state-level constraint on H-1B employment in public education — even though the visa programme itself remains under federal jurisdiction.
