Supreme Court Told Over 4,000 Criminal Cases Hang Over Sitting Lawmakers

Theindiapostdaily.com – In a filing before India's apex court, senior advocate Vijay Hansaria — serving as amicus curiae in a public-interest litigation — disclosed that more than 4,192 criminal matters remain unresolved against currently serving members of Parliament and state legislatures. Of those, 519 have been stalled for over ten years.

The disclosure emerged in a report tied to a PIL originally filed by BJP leader and attorney Ashwini Kumar Upadhyay, who has pressed for faster adjudication of criminal proceedings involving Indian legislators.

Scale of Pending Cases

According to the affidavit, roughly 251 of the 543 Lok Sabha members and 75 of the 233 Rajya Sabha members have criminal cases on record. An additional approximately 700 matters are still at the investigation stage, with 260 of those investigations dragging on for more than three years without a chargesheet being filed.

State-Wise Breakdown

Kerala tops the list for parliamentary representation: 95 percent of its MPs face criminal charges, the highest proportion in the country. Telangana follows at 82 percent, and Odisha at 76 percent. At the opposite end, Haryana and Chhattisgarh each have just a single MP under criminal scrutiny.

Among state assembly members, West Bengal leads with 58 percent of its MLAs facing serious cases, closely trailed by Kerala at 57 percent. Andhra Pradesh (56 percent), Telangana (49 percent), and Odisha (45 percent) round out the top five.

Chief Ministers Under Scrutiny

Fourteen of India's 28 state chief ministers carry serious criminal charges. Telangana's Revanth Reddy heads the list with 89 charges against him. West Bengal's Suvendu Adhikari follows with 29 pending cases. Karnataka's D K Shivakumar and Andhra Pradesh's N Chandrababu Naidu each have 19, while Kerala's V D Sathesan faces 18.

Amicus Plea for Special Tribunals

In light of these figures, Hansaria urged the Supreme Court to constitute dedicated courts tasked with expediting trials against both incumbent and former lawmakers. He further requested that the Court direct the respective High Courts with jurisdiction over these matters to actively track and monitor trial progress.
